This Cancellation Policy outlines the terms and conditions for canceling services with Bryttek Solutions Pvt. Ltd. Cancellation terms may vary based on the type of service and the specific service agreement. This policy applies in addition to any terms specified in individual service agreements.
2. Cancellation Rights
2.1 Client Cancellation
Clients may cancel services subject to the following conditions:
- Cancellation must be requested in writing (email or formal letter)
- Notice period requirements as specified in the service agreement
- Cancellation fees may apply based on work completed
- Any deliverables already provided remain the property of the client
2.2 Our Cancellation Rights
We reserve the right to cancel services in the following circumstances:
- Non-payment or repeated late payments
- Breach of service agreement terms by the client
- Illegal or unethical use of our services
- Failure to provide necessary information or cooperation
- Force majeure events preventing service delivery
3. Cancellation by Service Type
3.1 Project-Based Services
For custom development projects:
- Before Commencement: Full cancellation allowed with minimal or no fees
- After Commencement: Cancellation fees apply based on work completed
- Milestone-Based: Can cancel at any milestone, fees apply for completed milestones
- Notice Period: Typically 7-14 days written notice required
3.2 Ongoing/Recurring Services
For maintenance, hosting, and subscription services:
- Monthly Services: Cancel with 30 days notice
- Annual Services: Cancel with 60 days notice
- No Refund: For the current billing period already paid
- Prorated Refund: May be available for unused portions (subject to terms)
3.3 Consulting Services
For consulting and advisory services:
- Cancel at any time with written notice
- Fees apply for hours already utilized
- Unused retainer amounts may be refunded
- Completed deliverables remain with the client
4. Cancellation Process
4.1 How to Cancel
To cancel a service, please follow these steps:
- Send a written cancellation request to cancellations@brytteksolutions.com
- Include your service agreement number or invoice number
- Specify the effective cancellation date
- State the reason for cancellation (optional but helpful)
- Await confirmation from our team
4.2 Cancellation Confirmation
Upon receiving your cancellation request:
- We will acknowledge receipt within 2 business days
- Review the request and calculate any applicable fees
- Provide a cancellation confirmation with final billing details
- Process any refunds if applicable (see Refund Policy)
- Terminate services on the effective cancellation date
5. Cancellation Fees
5.1 Fee Structure
Cancellation fees are calculated based on:
- Work Completed: Fees for all completed work and deliverables
- Time Invested: Hours already spent on the project
- Third-Party Costs: Any costs incurred on behalf of the client
- Administrative Fees: If specified in the service agreement
- Early Termination Fees: For contracts with minimum commitment periods
5.2 No Cancellation Fees
Cancellation fees may be waived or reduced in cases of:
- Our failure to deliver as per agreement
- Material breach of agreement by us
- Mutual agreement for early termination
- Force majeure events
6. Effect of Cancellation
6.1 Immediate Effects
- All active work on the project will cease
- Access to project resources may be terminated
- Final invoice will be issued for work completed
- Any deliverables already provided remain with the client
6.2 Post-Cancellation
- Client retains ownership of completed deliverables
- Source code and documentation (if completed) will be provided
- No further support or maintenance (unless separately agreed)
- Confidentiality obligations continue to apply
7. Notice Periods
Required notice periods vary by service type:
- Project Services: 7-14 days written notice
- Monthly Services: 30 days written notice
- Annual Services: 60 days written notice
- Consulting: 7 days written notice
- Emergency Cancellation: May be available with additional fees
Notice periods are calculated from the date we receive your written cancellation request.
8. Partial Cancellation
For services with multiple components, partial cancellation may be possible:
- Cancel specific service components while retaining others
- Subject to service agreement terms
- Fees apply only to canceled components
- May require service agreement modification
9. Reinstatement
If you wish to reinstate a canceled service:
- Contact us within 30 days of cancellation
- Reinstatement may be subject to availability
- New service agreement may be required
- Reinstatement fees may apply
10. Dispute Resolution
If there is a dispute regarding cancellation:
- We will work with you to resolve the issue amicably
- Review the service agreement terms together
- Consider alternative solutions
- If unresolved, follow dispute resolution process in the agreement
